How to report a bad driver in Montana

If it is happening now

Call 911. A driver who is an active danger to other people is a police matter, and no app is a substitute for that call. Do not follow the vehicle, and do not try to get closer to read the plate.

After the fact

Your local police department’s non-emergency line takes reports of dangerous driving that has already happened. What each agency will act on varies, and a report generally needs the plate, the location, the time, and what you saw.

What the report has to contain

• Concerned citizens — including friends and family members — may file a Recommendation for Re-Examination (Form 32-1800) with the MVD.
• The form states its own authority and audience: in accordance with § 61-5-207, MCA and ARM 23.3.410, an individual may recommend a driver for re-examination, and the person making the recommendation must complete all required portions.
• The form must include your name and contact information.
• Recommendations submitted by law enforcement must include a written statement describing the specific reasons for the re-evaluation request (Mont. Admin. R. 23.3.410).

What happens to your name

Montana does not accept anonymous recommendations. Form 32-1800 requires your full name and contact details, and an unsigned or anonymous request is not acted on. Expect the driver to learn who filed: a driver called in for re-examination can ask for a copy of the recommendation, which carries your identity and your statement.

What the agency can do

• The MVD can require a knowledge and road or skills test where it has received reliable evidence that a driver might no longer be able to drive safely, or where a physical or mental condition is not accounted for by an existing restriction.
• A physician or other health care provider may include a Driver Medical Evaluation (Form 20-1900) explaining how a patient's condition might make them unsafe to drive; the department has SOLE responsibility for the licensing decision and also considers non-medical factors.
• The provider may recommend restrictions, and periodic driving evaluations, knowledge testing or medical reports at 6-month, 1-year or 2-year intervals.

What this route is, and is not

This is a fitness-to-drive referral, not a bad-driving complaint. It is built around a medical, cognitive or physical condition, and it asks for the driver’s name and date of birth — which a witness holding only a plate number does not have. Reporting a stranger who tailgated you is not what this channel is for.

What an Erk Score means

An Erk Score is a plate’s running rating from 0.0 to 5.0, computed from the reports filed against it and weighted by whether the reporter is verified. Endorsements from other drivers are counted on the report itself and do not change the score. Deleted and hidden reports are excluded, so a score only reflects reports currently standing.
