How to report a bad driver in North Dakota

If it is happening now

Call 911. A driver who is an active danger to other people is a police matter, and no app is a substitute for that call. Do not follow the vehicle, and do not try to get closer to read the plate.

After the fact

Your local police department’s non-emergency line takes reports of dangerous driving that has already happened. What each agency will act on varies, and a report generally needs the plate, the location, the time, and what you saw.

What the report has to contain

• A concerned FAMILY MEMBER, FRIEND OR CITIZEN may submit a written statement detailing why they believe the driver is not safe on the roadways.
• The statement must be SIGNED AND DATED by the reporting party.
• It should give specific details pertaining to the medical, physical or mental status of the individual. AGE IS NOT A SUFFICIENT REASON.
• NO THIRD PARTY OR ANONYMOUS INFORMATION WILL BE ACCEPTED — you must have observed it yourself and put your name to it.
• Where you are unable to discuss the situation with the driver's physician, you may submit the written statement instead.
• Form SFN 13671 Request for Re-Examination is for LAW ENFORCEMENT OFFICERS and CERTIFIED DRIVER EXAMINERS, who certify they personally interacted with the individual. Health care providers use the Medical Examination Report SFN 4569; vision specialists use SFN 2342.

What the agency can do

• The Medical Program Coordinator reviews the report and determines what retesting may be required based on the evidence presented.
• Under NDAC 37-03-03-02, where the director has good cause to believe a licensee is physically or mentally incompetent, they may on at least five days' written notice require physical, mental or driver examinations; expenses are borne by the licensee.
• Refusal or neglect to submit to examination is itself grounds for suspension or revocation.
• A judge with reasonable grounds to believe a licence holder is not competent may declare them disqualified; privileges are suspended until a new court order says otherwise.

What this route is, and is not

This is a fitness-to-drive referral, not a bad-driving complaint. It is built around a medical, cognitive or physical condition, and it asks for the driver’s name and date of birth — which a witness holding only a plate number does not have. Reporting a stranger who tailgated you is not what this channel is for.

What an Erk Score means

An Erk Score is a plate’s running rating from 0.0 to 5.0, computed from the reports filed against it and weighted by whether the reporter is verified. Endorsements from other drivers are counted on the report itself and do not change the score. Deleted and hidden reports are excluded, so a score only reflects reports currently standing.
