How to report a bad driver in Louisiana

If it is happening now

Call 911. A driver who is an active danger to other people is a police matter, and no app is a substitute for that call. Do not follow the vehicle, and do not try to get closer to read the plate.

After the fact

Your local police department’s non-emergency line takes reports of dangerous driving that has already happened. What each agency will act on varies, and a report generally needs the plate, the location, the time, and what you saw.

What happens to your name

Strong, and stated in policy. Form DPSMV 3005 or its equivalent is not considered a public record. The Department will not divulge any information contained in the reports, whether the case is outstanding or closed, and the licensed driver must obtain an order from a court of competent jurisdiction to have the name of the reporting individual released.

The law protects you for reporting. Louisiana's immunity statute does not cover you. La. R.S. 40:1356 grants good-faith immunity to licensed health care providers (§ B), members of the Louisiana Medical Advisory Board (§ C), and OMV employees and agents (§ E). Family members and private citizens are omitted, so filing DPSMV 3005 as a relative carries some civil exposure if the driver learns of the report and alleges bad faith. What protects you in practice is the confidentiality rule above: the report is not a public record, the OMV will not voluntarily release it or your identity to the driver, and the driver must obtain a court order to compel disclosure.

Louisiana is one of 18 of 51 US jurisdictions where a witness unrelated to the driver has no confirmed way to report them to the licensing agency. That gap is the reason Jerk Alert exists.

What an Erk Score means

An Erk Score is a plate’s running rating from 0.0 to 5.0, computed from the reports filed against it and weighted by whether the reporter is verified. Endorsements from other drivers are counted on the report itself and do not change the score. Deleted and hidden reports are excluded, so a score only reflects reports currently standing.
